Ministry of Labour, Invalids and Social Affairs announces industries, localities about the situation of occupational accidents in the year 2006 and some key measures to take work-related problems and occupational accidents prevention measures forward in the year 2007 as follows:
A. General situation
I. Number of occupational accidents
As reported by 64 provinces, cities in the year 2006 the general situation of occupational accidents was as follows:
· There were 5,881 occupational accidents (of which 505 cases causing deaths and 147 cases causing 2 victims and above)
· Total victims: 6,088, of which 536 persons killed and 1,142 persons seriously injured.
II. Situation of occupational accidents in localities.
1. 10 localities with the highest number of occupational accidents in 2006:
- Ho Chi Minh City: 782 accidents (making up 13.3% of the total accident cases nationwide) causing 798 victims (making up 13.11% of the total accident cases nationwide), of which there were 101 cases causing death cases, which killed 103 and seriously injured 99 other persons;
- Quang Ninh: 253 accidents (making up 4.3% of the total accident cases nationwide) causing 306 victims (making up 5.03% of the total accident cases nationwide), of which there were 41 cases causing death cases, which killed 59 and seriously injured 131 other persons;
- Dong Nai: 872 accidents (making up 14.83% of the total accident cases nationwide) causing 882 victims (making up 14.49% of the total accident cases nationwide), of which there were 30 cases causing death cases, which killed 31 and seriously injured 57 other persons;
- Binh Duong: 1,316 accidents (making up 22.38% of the total accident cases nationwide) causing 1,322 victims (making up 21.71% of the total accident cases nationwide), of which there were 20 cases causing death cases, which killed 20 and seriously injured 20 other persons;
- Ha Noi: 152 accidents (making up 2.58% of the total accident cases nationwide) causing 158 victims (making up 2.6% of the total accident cases nationwide), of which there were 16 cases causing death cases, which killed 16 and seriously injured 50 other persons;
- Long An: 27 accidents (making up 0.46% of the total accident cases nationwide) causing 34 victims (making up 0.56% of the total accident cases nationwide), of which there were 15 cases causing death cases, which killed 22 and seriously injured 12 other persons;
- Da Nang: 39 accidents (making up 0.66% of the total accident cases nationwide) causing 42 victims (making up 0.69% of the total accident cases nationwide), of which there were 13 cases causing death cases, which killed 13 and seriously injured 7 other persons;
- Can Tho: 25 accidents (making up 0.43% of the total accident cases nationwide) causing 25 victims (making up 0.41% of the total accident cases nationwide), of which there were 13 cases causing death cases, which killed 13 and seriously injured 7 other persons;
- Ba Ria-Vung Tau: 44 accidents (making up 0.75% of the total accident cases nationwide) causing 44 victims (making up 0.72% of the total accident cases nationwide), of which there were 11 cases causing death cases, which killed 11 and seriously injured 22 other persons;
- Hai Phong: 277 accidents (making up 4.71% of the total accident cases nationwide) causing 286 victims (making up 4.7% of the total accident cases nationwide), of which there were 10 cases causing death cases, which killed 10 and seriously injured 83 other persons;
2. Some localities had a higher number of occupational accidents causing deaths than year 2005 were Ho Chi Minh City, Quang Ninh, Long An, Can Tho, Ba Ria- Vung Tau, Thai Binh, etc.
B. ANALYSIS OF OCCUPATIONAL ACCIDENTS
The present situation of received occupational accidents reports and investigation is later than the requirements. As reported by 64 Departments of Labour, Invalids and Social Affairs, in the year 2006 the national number of occupational accidents causing deaths was 505 and killed 536 persons but by 25 January 2007, Ministry and Labour, Invalids and Social Affairs Inspection just received 244 investigation minutes on serious and death cases causing 265 deaths and 48 serious injured persons. Analysis from 244 investigation minutes on serious and death cases revealed some assessments as follows:
I. Ministries, sectors where many occupational accidents causing deaths occurred:
- Enterprises under Ministry of Industry: taking up 16.8% of the total accident cases and 20.75% of the total death cases.
- Enterprises under Ministry of Construction: taking up 11.07% of the total accident cases and 10.19% of the total death cases.
- Enterprises under Ministry of Transport: taking up 5.74% of the total accident cases and 5.28% of the total death cases.
- Enterprises under administration of localities (including State enterprises, private enterprises and foreign-invested enterprises): taking up 60.66% of the total accident cases and 58.49% of the total death cases.
- The rest belonged to other ministries and sectors such as Ministry of Agriculture and Rural Development, Ministry of Postal Services and Telecommunications, etc.
II. Corporations where many occupational accidents causing deaths occurred.
- Viet Nam Corporation of Coal and Mineral: taking up 12.7% of the total accident cases and 16.98% of the total death cases.
- VINACONEX Corporation: taking up 2.05% of the total accident cases and 1.89% of the total death cases.
- Song Da Construction Corporation: taking up 1.64% of the total accident cases and 1.51% of the total death cases.
- Viet Nam Corporation of Electricity: taking up 1.64% of the total accident cases and 1.51% of the total death cases.
- Viet Nam Corporation of Shipping: taking up 1.64% of the total accident cases and 1.51% of the total death cases.
- Thang Long Construction Corporation: taking up 1.23% of the total accident cases and 1.13% of the total death cases.
III. Production sectors where many occupational accidents causing deaths occurred.
- Sector of building and assembling civil, industrial and transport projects: taking up 34.43% of the total accident cases and 32.45% of the total death cases.
- Sector of coal mine: taking up 12.7% of the total accident cases and 16.98% of the total death cases.
- Sector of producing construction materials: taking up 9.02% of the total accident cases and 8.3% of the total death cases.
- Sectors of manufacturing and mechanics: taking up 7.8% of the total accident cases and 7.17% of the total death cases.
IV. Factors, equipment leading to many occupational accidents causing deaths.
- Regarding production space: taking up 21.72% of the total accident cases and 20.38% of the total death cases.
- Regarding lifting equipment, elevator: taking up 7.8% of the total accident cases and 7.55% of the total death cases.
- Regarding electric cables: taking up 6.15% of the total accident cases and 5.66% of the total death cases.
- Regarding electric welding machine: taking up 4.92% of the total accident cases and 4.53% of the total death cases.
- Regarding scaffold, work performance station: taking up 4.1% of the total accident cases and 4.15% of the total death cases.
V. Trauma factors leading to most occupational accidents causing deaths.
- Electric shock: taking up 20.1% of the total accident cases and 18.87% of the total death cases.
- Fall from height: taking up 16.4% of the total accident cases and 15.47% of the total death cases.
- Falling, weighing down objects: taking up 7.78% of the total accident cases and 7.17% of the total death cases.
- Rolling, clamping machinery and equipment: taking up 4.1% of the total accident cases and 4.15% of the total death cases.
- Fast scattering out objects: taking up 2.87% of the total accident cases and 2.64% of the total death cases.
VI. Key causes leading to occupational accidents causing deaths.
- Employers breaching: taking up 17.62% of the total accident cases and 16.23% of the total death cases.
- Victims breaching safety technique standards, codes of practices: taking up 15.57% of the total accident cases and 15.47% of the total death cases.
- Equipment didnot ensure work safety: taking up 13.11% of the total accident cases and 12.45% of the total death cases.
- Employers did not set up work safety procedures and measures: taking up 11.89% of the total accident cases and 11.32% of the total death cases.
- No work safety training, no personal protective equipment: taking up 4.92% of the total accident cases and 4.9% of the total death cases.
VII. Responsibility settlement
Of the 244 occupational accidents files investigated by provincial occupational accident investigation commissions, the files of 7 occupational accidents or 2.87% of the total of investigated and settled occupational accidents causing deaths were transferred to the People's Procuracy to consider criminal responsibility and sue individuals related to those 7 cases.
C. OVERALL ASSESSMENTS
From the situation of the analyzed occupational accidents above in 2006, it can be seen that:
1. Compared to 2005: the total number of 2006 occupational accidents increased by 31.13%, 2006 total victims by 31.6%; 2006 occupational accidents causing deaths by12.28%, the number of 2006 deaths by 11.75%.
2. Situation of occupational accidents investigation: Overall, occupational accidents were investigated as regulated in Joint Circular No. 14/2005/TTLT-BLDTBXH-BYT-TLDLDVN dated 08/3/2005 of the Ministry of Labour, Invalids and Social Affairs – Ministry of Health – Vietnam General Confederation of Labour. However, many localities were still late for sending investigation minutes to the Ministry of Labour, Invalids and Social Affairs. In 2006, some localities such as Quang Ninh, Ho Chi Minh City, Ha Noi, Da Nang, Binh Dinh, etc. promptly and timely investigated occupational accidents, of which Quang Ninh and Ho Chi Minh City.
3. Quality of 2006 occupational accidents report:
Many localities implemented well report on occupational accidents situation in accordance with the template and time as regulated in Joint Circular No. 14/2005/TTLT-BLDTBXH-BYT-TLDLDVN dated 08/3/2005 of the Ministry of Labour, Invalids and Social Affairs – Ministry of Health – Vietnam General Confederation of Labour. However, some localities still provided wrong report forms, report data inconsistent among columns and sections, or just data sums without analysis based on factors required by the template regulated. Especially, the report ratio of localities was generally very low, thus causing problems for summarizing and evaluating the national occupational accidents situation. To mitigate such problem in 2007, labour inspectors in localities shall seriously fine enterprises for not making occupational accidents reports every 6 months or 1 year as regulated in Decree No. 113/2004/ND-CP dated 16/4/2004 of the Government.
4. Physical losses and damages As reported by localities, physical losses and damages following occupational accidents in 2006 (in terms of expenses related to medicine, funeral, compensations for families of deaths and injured cases, etc.) amounted to VND46.597 billion, property losses VND3.853, and the total number of leaves of absence 56.122 days.
D. SOME SERIOUS OCCUPATIONAL ACCIDENTS CAUSING DEATHS IN 2006
1. An occupational accident caused by methane fire and explosion in a coal mine on 06/3/2006 at Thong Nhat Coal Company under Viet Nam Corporation of Coal and Minerals killed 8 persons. The main causes were because of inefficient check and supervision of the work safety regulations implementation process, slack safety regulations implementation of employees, and inefficient production management, thus resulting in serious consequences.
2. An occupational accident due to an exploded water bag in a coal mine on 31/3/2006 at Mong Duong Coal Company under Viet Nam Corporation of Coal and Minerals killed 4 persons. The main cause was because of inefficient check and supervision of the work safety regulations implementation process.
3. An occupational accident due to a collapse of a building in the process at Phu Nhon Living Quarter, 5 Precinct, Tan An Town, Long An Province on 20/10/2006 killed 7 persons and seriously injured 4 persons. There has been no official conclusion for the cause as the investigation is being in the process.
4. An occupational accident due to toxic gas released from a fish waste vault of Da Nang Ltd. Company, Ben Luc District, Long An Province on 14/10/2006 killed 2 and injured 4 other persons. The main cause was because of poor provision of necessary personal protective equipment to employees.
E. SOME KEY MEASURES NEED IMPLEMENTING IN 2007
Basing on the situations and causes of occupational accidents occurring in the year 2006, to take the prevention against occupational accidents forward in the near future, Ministry and Labour, Invalids and Social Affairs requests ministries, industries, localities and enterprises to well implement key contents as follows:
1- Labour inspectors shall strengthen inspection of the implementation of State regulations on occupational health and safety in all enterprises of all economic sectors. More attention shall be paid to non-State enterprises and sectors of construction, electricity-related repair and usage; mineral and stone mining; usage of equipment with strict requirements on work safety. In addition, there shall be resolute and timely measures to infringements of labour laws as stipulated in Decree No. 113/2004/ND-CP dated 16/4/2004 of the Government;
2- Ministries, industries, and corporations shall strengthen checks and directions to their sub-units to fully implement State regulations on occupational health and safety and labour protection regimes as well as organize training for work safety for employers as stipulated at Circular No. 37/2005/TT-BLDTBXH dated 29/12/2005 of Ministry and Labour, Invalids and Social Affairs; organize conferences to evaluate causes of occupational accidents for learning lessons and experiences in Ministries, industries, and corporations and propose solutions to mitigate and prevent occupational accidents, and review responsibilities and seriously settle enterprises and individuals where occupational accidents occur.
3- Employers shall regularly check machinery, equipment for improved working conditions to ensure safe work environment for employees; fully set up procedures, measures for occupational health and safety as guided by safety standards, and codes of practice and guide employees before they start work; organize training on occupational health and safety for employees as stipulated at Circular No. 37/2005/TT-BLDTBXH dated 29/12/2005 of Ministry and Labour, Invalids and Social Affairs and propagandize and educate employees in self-following regulations on occupational health and safety; especially pay attention to employees engaged in hard, dangerous and hazardous jobs or exposed to objects under strict requirements on occupational health and safety;
4- Consolidate statistics and reports requirements on occupational accidents nationwide; inspect, check special topics about reports regulations as well as resolutely impose financial fines over organizations who donot seriously follow requirements on report on occupational accidents;
5- Coordinate with competent organizations to accurately and timely investigate occupational accidents causing deaths in all economic sectors, particularly small-and medium-sized enterprises of complicated, hazardous production procedures negatively affecting work environments but with poor awareness of occupational accidents prevention;
6- Seriously settle individuals with poor awareness and responsibilities and breaching occupational health and safety regulations, and resolutely hold individuals related to serious occupational accidents causing deaths, if any, for their criminal responsibilities
7- Strengthen propaganda on legislations on occupational health and safety to enhance responsibility of units, business and production establishments and employees so that every one has better awareness of occupational accidents prevention./.
