Ministry of Labour, Invalids and Social Affairs announces industries, localities the situation of occupational accidents in 2007 and some key measures to take work-related problems and occupational accidents prevention measures forward in year 2008 as follows:
A. General situation I. Number of occupational accidents According to reports from 64 provinces, cities, the situation of occupational accidents in 2007 was as follows: - The total number of occupational accidents: 5,951 cases, of which there were 505 death cases, 78 cases of 2 victims and above, especially the case of collapsed Can Tho Bridge on 26 September 2007 with 53 deaths, 80 injuries and the case of stone slide at D3stone-pit, Ban Ve Hydroelectricity Plant Project (Nghe An) on 15 December 2007 with 18 deaths; - The total number of victims: 6.337 persons, of which there were 621 deaths and 2.553 serious injuries.
II. Occupational accident situation in localities 1. 10 localities with the highest numbers of occupational accident - related deaths in 2007 - Ho Chi Minh City with 117 deaths, 622 serious injuries of the total of 666 occupational accidents; - Vinh Long with 57 deaths, 83 serious injuries of the total of 5 occupational accidents; - Quang Ninh with 42 deaths, 147 serious injuries of the total of 400 occupational accidents; - Dong Nai with 23 deaths, 104 serious injuries of the total of 1,117 occupational accidents; - Binh Duong with 23 deaths, 49 serious injuries of the total of 653 occupational accidents; - Nghe An with 22 deaths, 43 serious injuries of the total of 63 occupational accidents; - Long An with 20 deaths, 20 serious injuries of the total of 35 occupational accidents; - Hai Phong City with 19 deaths, 14 serious injuries of the total of 89 - occupational accidents; - Ha Noi City with 17 deaths, 45 serious injuries of the total of 183 occupational accidents; - Da Nang with 17 deaths, 6 serious injuries of the total of 36 occupational accidents.
2. Some localities with a higher number of occupational accident related deaths than 2006 were Ho Chi Minh City, Dong Nai, Vinh Long, Long An, Nghe An.
B. analysis of occupational accidents
The situation of reporting, investigating occupational accidents is currently later than the regulations. According to reports of 64 Departments of Labour, Invalids and Social Affairs, in 2007, there were 505 work-related accidents causing deaths, which killed 621 persons nationwide. However, by 25 January 2008, Ministry of Labour, Invalids and Social Affairs had just received only 240 investigation reports on serious occupational accidents and deaths, which led to 265 deaths and 48 serious injuries. An analysis from 240 investigation reports on work-related deaths provides some conclusions as follows:
I. Ministries, industries where many work-related deaths occurred - Enterprises of Ministry of Industry and Trade accounted for 19.8% of the total number of cases of the total number of cases and 1536% of the total number of deaths; - Enterprises of Ministry of Construction accounted for 9% of the total number of cases and 12.29% of the total number of deaths; - Enterprises of Ministry of Transport accounted for 4.5% of the total number of cases and 21.18% of the total number of deaths; - Enterprises under local administration (including State-owned enterprises, private enterprises and foreign-invested enterprises) accounted for 57.66% of the total number of cases and 45.05% of the total number of deaths; The 2007 the proportion of the number of occupational accidents under the administration of Ministries, industries was similar to the 2006 one, except for a higher proportion of deaths in Ministry of Transport due to the case of collapsed Can Tho Bridge.
II. Production sectors where many work-related deaths occurred - The sector of constructing and assembling civil, industrial and transport projects accounted for 27.86% of the total number of cases and 44.37% of the total number of deaths; - The sector of mineral exploitation accounted for 12.93% of the total number of cases and 14.29% of the total number of deaths; - The sector of construction material production accounted for 4.98% of the total number of cases and 5.12% of the total number of deaths; - The sector of mechanical production accounted for 7.8% of the total number of cases and 7.17% of the total number of deaths.
III. Factors, equipment causing many work-related deaths - Production space - related cases accounted for 20.2% of the total number of cases and 22.08% of the total number of deaths; - Lifting, elevator - related cases accounted for 8.8% of the total number of cases and 9.55% the total number of deaths; - Welding machine - related cases accounted for 7.92% of the total number of cases and 8.53% the total number of deaths; - Scaffolding, operation floor work - related cases accounted for 6.8% of the total number of cases and 7.18% of the total number of deaths; - Electricity cable - related cases accounted for 6.15% of the total number of cases and 6.66% of the total number of deaths.
IV. Types of injuries causing most work-related deaths - Electricity shock accounted for 20.1% of the total number of cases and 18.87% of the total number of deaths; - Falling from high positions accounted for 16.4% of the total number of cases and 15.47% of the total number of deaths; - Rolling, clamping machines and equipment accounted for 14.1% of the total number of cases and 14.25% of the total number of deaths; - Falling, weighing down objects accounted for 7.78% of the total number of cases and 10.17% of the total number of deaths, of which, in 2007, in the stone exploitation sector there were 6 stoneslide cases, which caused 23 deaths; more seriously a case of stone exploitation at Ban Ve Hydroelectricity Plant Project killed 18 persons.
V. Major causes resulting in work-related deaths Causes from employers accounted for 35.53% of the total number of cases, from employees accounted for 30%, and objective causes or unidentified causes accounted 34.47% of the total number of cases occupational accidents. Details are: - Employers violating technical standards, codes of practice, rules accounted for 17.62% of the total number of cases; - Employers did not develop safety working process, protection measures accounted for 11.89% of the total number of cases; - No occupational safety training, no personal protection equipment accounted for 4.72% of the total number of cases; - Equipment not ensuring occupational safety: accounted for 1.7% of the total number of cases; no safety equipment accounted for 2.2% of the total number of cases; - Victims violating occupational safety regulations accounted for 25.3% of the total number of cases; - Victims not using personal protection equipment accounted for 4.7% of the total number of cases.
VI. Investigation of responsibility for occupational accidents Of the 2007 investigation reports on the 240 occupational accidents that Ministry of Labour, Invalids and Social Affairs received, only one case was transferred to the People’s Procuracy to request for criminal responsibility investigation and prosecution towards related individuals. Some especially serious occupational accidents causing deaths in 2007 have not been investigated completely, thus no settlements have been provided.
C. general assessments 1. Compared to year 2006: in 2007 the cases of occupational accidents increased by 70 with 249 victims. The number of work-related death cases remained the same increased but the number of deaths increased by 85 persons. Especially, the number of serious injuries in 2007 increased by 1,141 persons in comparison with 2006.
2. Situation of investigation occupational accidents In general, the occupational accidents were investigation as regulated in Joint Circular No. 14/2005/TTLT-BLDTBXH-BYT-TLDLDVN dated 08/3/2005 of Ministry of Labour, Invalids and Social Affairs – Ministry of Health – Vietnam General Confederation of Labour . However, many localities still delayed their investigation reports to Ministry of Labour, Invalids and Social Affairs. In 2007, some localities, which implemented the investigation of occupational accidents and timely reported to MOLISA were: Quang Ninh, Ha Noi, Ho Chi Minh City. Quang Ninh was the only province, which seriously executed the quick report regime on work-related deaths Ministry of Labour, Invalids and Social Affairs.
3. Quality of reports on occupational accidents in 2007 Many localities reported situations of occupational accidents well according to the template and time requirement in Joint Circular No. 14/2005/TTLT-BLDTBXH-BYT-TLDLDVN dated 08/3/2005 of Ministry of Labour, Invalids and Social Affairs – Ministry of Health – Vietnam General Confederation of Labour. However, some localities still sent incorrect report forms, report data inconsistent among columns and lines, or only reported the total number without analyzing factors as required in the provided templates. Especially, the proportion of reports from enterprises to local Departments of Labour, Invalids and Social Affairs remained very low (in 2007 only 4.5% of the enterprises nationwide reported); thus, causing difficulties for finalization and assessment of the situation of occupational accidents at the national level. Local Departments of Labour, Invalids and Social Affairs also delayed their reports to Ministry of Labour, Invalids and Social Affairs. To mitigate this situation, in 2007, inspectors of local Departments of Labour, Invalids and Social Affairs shall seriously punish enterprises who donot periodically report occupational accidents as stipulated in Decree No. 113/2004/ND-CP dated 16/4/2004 of the Government.
4. Physical losses According to report data of localities, physical losses caused by occupational accidents occurring in 2007 (expenses relating to medical and treatment, burial services, compensations for families of the deaths and injuries, etc.) were VND48,035 billion, property losses were VND10,493 billion. The total number of days-off due to occupational accidents amounted 382,313 days.
D. Some key measures need to apply for year 2008 Based on situation and causes of occupational accidents in 2007, to take the prevention and limitation measures forward, in the short-term, Ministry of Labour, Invalids and Social Affairs would like to request ministries, sectors, localities and enterprises to implement well the key solutions as follows:
1. Consolidate the inspection of the implementation of State stipulations on OSH at every unit in all types of economic ownership. The inspection shall focus on sectors of construction; installment, electricity repairing and using; mineral and stone exploitation; using equipment of strict requirements of occupational safety; key construction projects using many seasonal employees; non-State enterprises. Serious and timely settlements shall be imposed on violations breaking labour regulations as regulated on Decree No. 113/2004/ND-CP dated 16/4/2004 of the Government;
2. Ministries, sectors, corporations shall consolidate the checking and guiding the sub-units to fully implement State stipulations on OSH and labour protection. Training on occupational safety shall be organized for employers as stipulated in Decree No. 37/2005/TT-BLDTBXH dated 29/12/2005 of Ministry of Labour, Invalids and Social Affairs. Conferences shall be organized to fully evaluate causes of occupational accidents to propagandize for future experiences in all sectors, corporations, and simultaneously necessary measures shall be proposed to prevent and mitigate recommend occupational accidents. Organizations and individuals causing occupational accidents shall be seriously examined and punished;
3. Employers shall regularly check machinery and equipment; improve working conditions to ensure a safe working environment for their employees. OSH procedures and standards shall be fully developed as regulated in Technical and OSH Standards, Procedures and instructed to employees before they start work. Full OHS training shall be provided employees as stipulated in Circular No. 37/2005/TT-BLDTBXH dated 29/12/2005 of Ministry of Labour, Invalids and Social Affairs and propaganda and education shall be also provided for employees’ self-implementation on OHS stipulations. Special attention shall be paid to employees engaged in hard, dangerous and hazardous jobs or exposed to objects of strict OHS conditions requirements;
4. Regulations on statistics records, reports on occupational accidents at the national level shall be improved: by consolidating inspection, checking topics on statistics, report duties as well as seriously applying financial settlements over establishments who donot seriously implement regulations on occupational accident report;
5. Coordinate with competent bodies to timely, accurately investigate, work-related deaths in economic sectors of all types of ownership, particularly small- and medium –sized with obsolete production processes; usage of hazardous chemicals negatively affecting environment but poor awareness of occupational accident prevention;
6. Serious settlements shall be imposed on individuals with poor awareness and responsibility, violations of OHS stipulations and resolutely propose the prosecution of criminal responsibility for related individual if they have violations against the labour legislation, which cause the leading serious work-related deaths;
7. Consolidate the propaganda the OHS legislation to raise awareness of responsibility of production and business units, establishments and employees for higher protection of occupational accidents./. Nguồn:
