Establishment of The National Councillor Labour Protection

On February 28th 2005, the Prime Minister of Viet Nam is­sued Decision No. 40/2005/QD­ TTg on the establishment of the National Council for Labour Pro­tection. The council is responsi­ ble for assisting the Prime Min­ ister in providing guidance, direc­ tion and policies related to the field of labour protection, and for coordinating activities among Ministries, branches and organi­zations in the field, to ensure oc­cupational health and safety standards.

According to this Decision, the Council comprises 15 mem­bers representing Gov­ ernment agencies, employers and employees' organizations, and is based according to principle of democractic, free discussions with voting on significant issues.

The Council's struc­ture comprises a Chair, 2 Vice Chairs, Members, Standing committee and the Secretariat. The Minister of Labour, In­ valids and Social Affairs (MOLISA) acts as the Council Chair, and Council members work on a concurrent basis.

The National Coun­cil for Labour Protection held its first meeting on May 18th 2005, chaired by the Minister for MOLISA, Madam Nguyen Thi Hang. The Council discussed the draft working regulations of the Council and the draft "National Program on Labour Protection in 2006-2010".

Discussing the working reg­ulations of the Council, council members focused on determin­ing the tasks, responsibilities of different members and developing an effective council mecha­nism.

Most opinions resolved that each Ministry must be responsi­ble for their own assigned OSH, labour protection issues and the Council be responsible for gener­ al issues stipulated by the govern­ment. The advisory role to the Prime Minister should be further stressed in the regulations.

The National Program on Labour Protection is scheduled to be submited to the govern­ment for comments and deci­sions in late 2005 prior to sub­mission to the National Assem­bly for budget. In this meeting, the Council spent most of the time discussing the draft "Na­tional Program on Labour Pro­tection in 2006 - 2010".
