Circular Guiding Training in OSH

The Ministry of Labour, Invalids and Social Affairs issued Circular No 37/2005/TT­ BLDTBXH guiding training in occupational safety and health dated 29 December 2005 in replacement of the Circular No 08/LDTBXH- TT dated 11 April 1995 and Circular No 23/LDTBXH- TT dated 19 September 1995.

As stipulated in Circular No 3.7/2005/TT-BLDTBXH, emp­loyers, employees and officers in charge of occupational safety and health at undertakings and enterprises should be trained in occupational safety and health upon their first joining and annually. Periodical training duration depends on the actual need of occupational safety and health at the undertakings but should last at least two days every year for employees and the officer in charge of occupational safety and health and every three years for employers. After being trained and passing a test, the employees engaged in the jobs with strict occupational safety and health requirements shall be granted with card of occupational safety while employers and the officers in charge of occupational safety and health shall be granted with certificate for attending OSH training.

Responsibility for training provision is taken by target groups, industries, sectors and areas. Accordingly, employers are responsible for organizing trainings for employees; provincial Departments of Labour, Invalids and Social Affairs, Management Units of Industrial Zones are responsible for organizing trainings for employers, officer in charge of occupational safety and health in their locality; ministries, industries, economic groups, corporations are responsible for providing trainings for employers, OSH officers in their affiliates. For the undertakings and enterprises employing contractor or allowing workers from other enterprises to work on their site, Circular No 37/2005/TT-BLDTBXH stipulates that the owner of undertakings and enterprises must assign tasks to the contractor, leader of task forces organizing OSH trainings as well as supervise and monitor strictly their performance. Trainings for uncontracted workers shall be provided by the employing side.

Besides, training-related activities should be carried out carefully through all steps of planning, organization, setting up training recording book, granting, , revoking and issuing certificates and cards of occupational safety .... /.
